Trademark protection

In order to protect your trademark, you must register it in a trademark register. That may be either the Benelux or the European Trademark Register, or another national trademark register. This depends on the area in which you wish to protect your trademark. Unlike in the case of patents, both new trademarks and trademarks in general use can be protected. A trademark therefore need not be new on the date on which it is registered.
